General terms and conditions

Our online shop will only accept orders from residents in Spain and abroad if these are to be delivered in Spain (excluding the Canary Islands, Ceuta and Melilla).

Purchases made directly via the www.cacaosampaka.com website are subject to product availability.

The online purchasing process is as follows:

1. Shopping basket: All products selected by the User will be added to the "Shopping basket". Users need to access the "Shopping basket" to initiate the checkout process.

2. Users do not need to be registered to proceed with purchase.

Users who are already registered only need to enter their username and password. 

Once registered, Users can fill in their order delivery details.  Users who do not wish to register can still access this purchase data entry area and proceed just like registered Users.

3. Shipping options: As the User selects the city of delivery, the relevant shipping (transport) costs are displayed along with a calendar with suggested delivery dates. Users are also given the option of choosing a specific delivery date from Monday to Friday within one month of the date of purchase. The only day on which orders cannot be delivered is Sunday.

4. Payment options: Users can choose to pay by credit and debit card, VISA or MASTERCARD.

5. Acceptance: By clicking the "Confirm Order" button, the User agrees to the purchase of the selected products.

6. Confirmation of receipt of acceptance:  Once the sale is completed, the User is sent a message at the email address specified in the registration form listing the characteristics of the product, price, shipping method, purchase date, purchase order number and estimated delivery date.

7. If for whatever reason the order cannot be processed, the User will receive an email notification informing him of the issue.

Product availability

At CACAO SAMPAKA, you can buy the following products online:

• Chocolates, chocolate tablets, temptations, jams and spreads.

• Gifts and products for special celebrations.

• Business/corporate gifts

All products are subject to availability. 

Prices

The prices shown on the website are indicated in euros. Although they have been checked to avoid any errors, if we detect any mistakes on the website, we will contact you to discuss this and give you the option to either accept the new price or cancel your order.

If we are unable to get in touch with you, our understanding will be that the order is cancelled.

The prices shown for each product include Value Added Tax (VAT) and are expressed in Euros (€).

These prices, unless explicitly stated otherwise, do not include shipping, insurance or any other complementary services related to the product or service purchased. Neither do they include Cash on Delivery expenses, if applicable.

Prices for each product are those published on the website, and then automatically applied during the final stage of the purchasing process.

Payments

Payment can be made ​​by credit card or debit card (VISA and Mastercard).

1. If you are paying by credit card, the amount of your order will be blocked and you will not be charged until the order has been shipped. This transaction is supported by most banks.

2. If you are paying by debit card, you will be charged automatically at the time of purchase.

Please note that your order is not confirmed and the items selected are therefore not reserved until you have completed your purchase.

CACAO SAMPAKA reserves the right to withhold any order for security reasons, in which case it will inform the customers affected. We also reserve the right to cancel an order if we find ourselves unable to verify the billing and shipping information, or if we believe that the goods are intended for resale by the purchaser.

Our server encrypts all personal information, guaranteeing the privacy and security of your transactions.

Taxes

CACAO SAMPAKA applies the taxes required by Spanish law to products reserved online, and all prices include 10% VAT. 

Delivery: methods, times and shipping costs

Purchases made on the CACAO SAMPAKA website may not be delivered to post office boxes; they are always delivered to the person and home address indicated at the time of confirmation of the purchase.

CACAO SAMPAKA shall accept no liability whatsoever if the delivery of the product or service cannot be completed as a result of inaccurate or false information provided by the User, or due to reasons beyond the control of the carrier appointed for this purpose, such as the absence of the recipient.

The estimated delivery time is around 24/48 hours, depending on the day and time of confirmation.

Orders confirmed before 02:00 pm will be processed and shipped the same day, and received before 07:00 pm the next business day.

Between 15 April and 15 October, all orders will be delivered refrigerated and with isothermal packaging to keep the products in good condition. In addition, during this period, no deliveries will be made on the days after public holidays to ensure that the cold chain is maintained.

Any incident will be reported via email or a telephone call to the number provided.

If at the time of delivery, there is no one present at the address indicated, the carrier will leave a note for the recipient to contact the agency and rearrange delivery as quickly as possible.

In case of any issues at the specified delivery address, the courier company will leave a receipt indicating how to proceed to rearrange delivery. There will be two delivery attempts, the first one on the next day, and the second after rearranging delivery.

At Cacao Sampaka, we have organised the logistics of delivery so as to ensure that the products travel in optimal conditions; therefore, it is important for orders to be received on the first delivery (after 24 hours), as we may not be held responsible for the state of the goods from two days after the planned delivery.  Customers will not be able to reclaim the purchase price.

You can also change the delivery date specified by the system according to the above conditions within one month from the date of purchase.  Customers can thus choose to have their order delivered on a specific date (e.g.: birthdays, Christmas, Valentine's day...)

Order Tracking

Users can track their orders via the "My account" section of the website. They will also receive a confirmation email with the expected delivery date.

The "Pending orders" section will show the current status of the order.  

• Order being prepared for shipping (order being processed)

• Sent (order shipped to the recipient)

• Delivered (order delivered to the recipient)

The "History" section shows the list of earlier purchases made by the User.

Should CACAO SAMPAKA be unable to deliver the products ordered due to their being out of stock, Users will be notified immediately and given the option to choose from the following solutions:

• Request a refund for the amounts that would have been paid for the products.  CACAO SAMPAKA shall ensure such refunds are received within 30 days.

• Allow CACAO SAMPAKA to supply products with similar characteristics at no added cost.

Cancellation policy

CACAO SAMPAKA will accept cancellations without charge for any orders cancelled 24 hours in advance of the expected date of delivery. The company makes no commitment to meet such requests after the deadline, but exceptionally, and provided that the goods have not been shipped, the request may be considered. To request a cancellation, please send an email to pedidos@cacaosampaka.com specifying the expected delivery date, your name and order number. 

Guarantees

Our Customer Service department provides an after-sales service to solve any problems you may have with our products or shipments, and which aims to bring our customers quick and effective solutions.

Errors

We strive to bring you a website with up-to-date, error-free information. However, we cannot guarantee the absence of human or technical errors.

This website may contain some typos, inaccuracies or omissions in relation to product prices, availability or information. At CACAO SAMPAKA, we apologise for any omissions or mistakes you might come across and welcome your comments and advice, which help us continue to improve.

CACAO SAMPAKA reserves the right to correct such errors, inaccuracies or omissions without prior notice, even if this affects outstanding orders.
